When people move they usually talk of the stress and often of the stress of dealing with their own solicitors! There are two underlying causes of stress:

1. Delay

2. Not knowing what is going on.

THE MOVING PROCESS

Selling your home

You will want to obtain the true worth of your home when you are selling. A responsible estate agent will ensure that you know its market value and help to find you a buyer at that price. If you need help in finding a suitable agent then we at Lovetts will be pleased to offer advice.

Buying and selling

There can be several people in the same position as you, selling and buying. The person buying from you may have to sell their present home. The person selling to you may need to find somewhere to move to. Together you will form the "chain" of which you may have heard. Obviously no-one can move until everyone is ready. Some people may need a mortgage; all will probably need a survey.

Making an offer

When you find the property that you decide is right for you then you will need to "make an offer". This will be what is called "subject to contract".  That means that you are not legally committing yourself to a purchase until you have been assured:

Firstly: that the property is in good condition (by means of your survey)

Secondly: that you can borrow any money that you need (your mortgage)

Thirdly: that the property has no legal problems (that is Lovetts main task).

As you can see, things can be uncertain for a while. You will find it helpful to ask people approximately when they are hoping to move - then no-one will be taken by surprise.

It is important that you get good independent advice. If you need help, Lovetts can assist.

Working for you

Your home is likely to be by far the biggest purchase you will ever make. What is more, you will spend a high proportion of your life there. You need to be certain that your investment is safe and that your enjoyment will not be spoilt by unexpected problems. That is our job.

We do this by:

1. Checking the legal title

2. Ensuring that you have all rights that you may need over other people’s land

3. Making sure you know exactly what rights others may have over your land

4. Enquiring with the council on planning, public health, highways, compulsory purchase etc

5. Investigating any restrictions upon your use of the property

6. Checking on the management of the property (if it is leasehold)

6. Advising you on your mortgage offer

We tell you as much as we know just as soon as we know it - you are always kept in the picture.

When you are entirely happy with your purchase and everyone else is ready then we "exchange contracts". At that stage you and the other parties become legally bound to proceed and a firm date is made for the move ("completion"). This is usually about 2 weeks after the exchange of contracts but it can sometimes be quicker.

We will then prepare and have signed the final documents, confirm to any lender that all of their requirements are met and obtain the mortgage money. We also ask you for any money that you are paying yourself. We will then "complete" and you will move.

Our work for you is not yet finished. We now pay the estate agents, repay any mortgage on your previous property, pay the "stamp duty" (tax) on your new property and register the title at the Land Registry. When all of this has been done we send you a copy of the final deeds and forward the originals to the building society.
